Thank you for participating in the beta test of Opulence AI. These Terms and Conditions ("Terms") govern your use of the App during the beta phase and your participation in testing and providing feedback. By accessing or using the App, you agree to comply with and be bound by these Terms.

1. Beta Testing Disclaimer

1.1 Beta Version: The App is in a testing phase and is provided to you as part of a beta program. During this phase, the App is still under development and may contain bugs, errors, or incomplete functionality. The App is being made available to you for testing purposes only and may not reflect the final version of the product.

1.2 No Financial Services or Products: The App does not provide real financial services, investment management, or retirement account management (including IRAs or other financial products) during the beta phase. Any financial data or services presented in the App are for simulation or testing purposes only and do not reflect actual financial transactions or advice.

1.3 No Real Transactions or Investments: No real money transactions, investments, or financial decisions should be made using the App. You acknowledge that any financial activities or transactions shown within the App are purely for testing and are not to be considered actual financial operations.

1.4 No Solicitation or Financial Offering: The App is not intended to provide or solicit any investment advice, investment management, or the offering of securities, nor does it enable users to manage or open IRAs or other retirement accounts during the beta phase. The App does not facilitate or offer any financial product or service that would be subject to regulation by the SEC or any similar regulatory body.

1.5 Beta Testing Nature: By using the App, you understand that the features and functionalities may change or be removed entirely at any time during the testing phase. You also understand that the App may not be fully functional and is provided "as is" for feedback and testing.

2. Privacy and Data Usage

2.1 Data Collection: During the beta test, we may collect certain data from you, including but not limited to usage statistics, bug reports, and feedback. However, we will not collect or process sensitive financial information, such as personal financial data or bank account details, unless explicitly required for testing purposes.

However, as the App is in its beta phase, please be aware that we may not have full privacy protections in place until the App is officially released. By participating in the beta, you acknowledge that the data collection and processing may be less comprehensive than in a fully launched version of the App.

2.3 Non-Disclosure: You agree not to share any confidential information regarding the App’s features, design, or functionality with unauthorized third parties, except for feedback purposes directly with Opulence AI.

3. Usage Restrictions

3.1 Limited License: We grant you a limited, non-exclusive, non-transferable license to access and use the App for the purpose of testing and providing feedback. You may not use the App for any commercial or financial transactions, including but not limited to investment management, trading, or financial advising.

3.2 No Investment Advice: The current application does not provide sound investment advice, financial services, or retirement account management. You acknowledge that you are using the App for testing purposes only and that no advice or financial guidance should be construed from the App’s functionality. The App is not an offering of any securities, financial products, or services under applicable federal or state law, including the Securities Act of 1933 or similar laws.

3.3 Prohibited Uses: You may not use the App to:

Engage in real financial activities such as opening or managing retirement accounts (e.g., IRAs).
Perform any illegal activities or violate any laws.
Share or transmit false or misleading information through the App.
Attempt to reverse-engineer, decompile, or modify the App in any way.
Use the App for any commercial purpose, including providing investment advice, managing financial accounts, or acting as a financial intermediary.

4. Limitations of Liability

4.1 No Warranty: The App is provided "as is," and we make no representations or warranties, express or implied, regarding the App's functionality, accuracy, or completeness. We do not guarantee that the App will meet your expectations or be free of errors or interruptions.

4.2 Indemnification: You agree to indemnify, defend, and hold harmless Opulence AI and its affiliates, employees, contractors, and partners from any claims, damages, or liabilities arising out of your use of the App during the beta phase.

4.3 Limitation of Liability: To the maximum extent permitted by law, Opulence AI will not be liable for any direct, indirect, incidental, special, or consequential damages arising out of your participation in the beta testing, including but not limited to loss of data, business interruption, or any other damages.

5. Gramm-Leach-Bliley Act (GLBA) Compliance

5.1 Non-Collection of Sensitive Financial Data: We will not collect, process, or store any personal financial information, including account numbers, passwords, or other sensitive data unless explicitly required for testing purposes. As this is a beta version, the application does not yet fully comply with all regulatory requirements, including the Gramm-Leach-Bliley Act (GLBA) or other financial privacy laws.
